These Terms of Service (“Terms”) govern your use of smallstacks.net and the website design, hosting, and AI services provided by Smallstacks (“we,” “us,” or “our”). By using our Site or Services, you agree to these Terms.
The Services
Smallstacks designs, builds, hosts, and maintains websites for small businesses, and — on higher plans — provides AI tools such as a website chatbot, appointment booking, lead follow-ups, and review management. The exact features depend on the plan you choose.
Plans, billing, and renewal
Plans are offered on a recurring subscription basis (monthly or annual) at the prices listed on our pricing page. By subscribing, you authorize us, through our payment processor (Stripe), to charge your payment method on a recurring basis until you cancel. We may change prices with notice; changes apply to future billing periods.
Domains
Domain names are purchased separately and are owned by you, not Smallstacks. We can help you find and register a domain — and we aim to find you a low-cost option — but domain fees are your responsibility and are billed by the registrar.
Cancellation and refunds
You may cancel at any time. Cancellation stops future renewals, and your Services continue until the end of the current billing period. We offer a 14-day money-back guarantee on your first payment: if you’re not satisfied within 14 days of your initial charge, contact us for a full refund. After cancellation, your website may be taken offline; on request, we will provide a reasonable export of your content. You keep your domain.
Your content and responsibilities
You are responsible for the accuracy of the information you provide and for ensuring you have the rights to any content (text, images, logos) you give us. You retain ownership of your content and grant us a license to host, display, and adapt it as needed to provide the Services. You agree not to use the Services for unlawful, harmful, infringing, or deceptive content.
Our intellectual property
We retain all rights to our platform, software, templates, and underlying technology. Your subscription grants you the right to use the website and tools we provide while your plan is active; it does not transfer ownership of our underlying systems.
Service availability
We work hard to keep your site fast and online and aim for high availability, but we do not guarantee uninterrupted or error-free Service. Maintenance, third-party outages, or events beyond our control may cause downtime.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Smallstacks will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three (3) months before the claim.
Indemnification
You agree to indemnify and hold Smallstacks harmless from claims arising out of your content or your use of the Services in violation of these Terms or applicable law.
Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date; continued use of the Services means you accept the changes.
