Terms of Service
Last updated: October 27, 2026
These Terms of Service (“Terms”) govern your use of smallstacks.net and every product sold by Smallstacks LLC, a Tennessee limited liability company (“Smallstacks,” “we,” “us,” or “our”): our websites, the Stacks AI chat assistant, Stacks Ads, Stacks Academy and the AI agents we build (together, the “Services”). By using our Site or Services, you agree to these Terms. If a product shows you extra terms when you sign up for it, those apply to that product too.
Eligibility
You must be at least 18 years old to create a Smallstacks account or buy our Services. By creating an account, you confirm that you are 18 or older and, if you sign up on behalf of a business, that you are authorized to act for it. One Smallstacks account opens every product.
The Services
- Websites. We design, build, host and maintain a website for your business, on a monthly plan. The Pro and Pro+ plans include the Stacks AI chat assistant on that website.
- Stacks AI. A chat assistant you add to any website, ours or not, that answers your visitors’ questions from what you tell it about your business, and can take their contact details and bookings for you.
- Stacks Ads. Ad images and videos made for your business, with the words to post them and instructions for running them.
- Stacks Academy. A course on using AI assistants at work, at academy.smallstacks.net, sold as seats for a team, with a certificate for finishing it and an agent desk where a team’s AI agents write drafts.
- AI agents. A small AI agent built around one job in your business, from a free written plan with a fixed price, that belongs to you once it is built and paid for.
The exact features depend on the plan you choose, as described on each product’s page and at checkout.
Free mockup and build fee
Before you pay anything, we design a mockup of your website at no charge. Asking for a mockup does not require a payment method and does not commit you to buy. If you decide not to go ahead, you owe nothing; the mockup and its design remain ours and are not launched as your website or handed over.
If you decide you want the website, you pay a one-time build fee of $250 and your monthly plan begins. We then finish the site and launch it on your domain. Nothing is charged until you tell us to go ahead.
Plans, billing, and renewal
Plans are monthly subscriptions at the prices shown on each product’s page and at checkout. Stacks Academy seats, and the build of an AI agent, are paid once instead; see their sections below. By subscribing, you authorize us, through our payment processor (Stripe), to charge your payment method each month until you cancel. Prices do not include any sales tax that may apply where you are; if tax applies, it is shown at checkout. We may change prices with at least 30 days’ notice by email; a change applies from your next billing period after the notice, and you can cancel before it takes effect.
If a payment fails, Stripe tries it again. While a payment is overdue, the Service may be paused until it is paid, and a subscription that stays unpaid may be cancelled. Pausing a website or chat assistant does not delete it.
Free trials
Some products, such as the Stacks AI chat assistant, start with a free trial of the length shown when you sign up (currently 3 days). You add a payment method when the trial starts; nothing is charged during it. When the trial ends, the plan you chose is charged automatically, and then every month, until you cancel. We email you before the first charge. To avoid being charged, cancel before the trial ends from your Smallstacks account (Manage billing). Each product’s free trial is available once per account, once per website and once per payment card; if a card has already had a trial, a new trial on it is cancelled straight away, without charge; during a trial, the product may only be used on the website the trial was started for. We may end a trial early, or decline one, where we reasonably believe these limits are being avoided, for example by opening further accounts for the same business.
Content made with artificial intelligence
Stacks AI, Stacks Ads, the AI agents we build, Stacks Academy’s agent desk and parts of the websites we build use artificial intelligence: models from providers such as Anthropic and Cloudflare, and models we run ourselves. They work from what you tell us and from your website. We instruct them to use only the facts you give and not to invent prices, offers, reviews or claims, but AI can still get things wrong. So:
- You review what is made for you before you rely on it: every ad before you post it, every draft an agent writes before you use it, and what your chat assistant knows before you switch it on.
- You are responsible for the facts you give us. If an ad or the assistant states a price, an offer or a promise you gave us, you honour it.
- What the AI makes is not professional advice (legal, medical, financial or otherwise), and we do not promise any result from it, such as more customers, clicks or sales.
- Because it is made by AI, similar images, words or replies may be made for others, and we do not promise that anything made by AI can be protected as your exclusive intellectual property.
Stacks AI chat assistant
The assistant answers your visitors from the information you give it, which you can read and change in your dashboard at any time. It tells visitors it is an AI assistant; you agree not to hide or remove that. Each plan includes a number of visitor messages a day, shown at checkout; when the day’s allowance is used up, the assistant pauses until the next day.
You are responsible for what your assistant is set up to say and for following up on the people who leave their details with it. Use the contact details it collects only to reply to that person about what they asked, under the laws that apply to you (for example, do not add them to marketing texts or calls without their consent). Do not use the assistant for emergencies or to give medical, legal or financial advice, and do not set it up to collect payment card numbers, government ID numbers or health information. The assistant runs on your website on your behalf: your own privacy policy should say that your site uses a chat assistant provided by Smallstacks.
Online booking and payments
If your website takes bookings or payments through Smallstacks, the bookings are your business’s bookings and the payments are taken on your own Stripe account, under Stripe’s terms with you. The money goes to your Stripe balance; Smallstacks takes no fee from it and never holds it. Stripe’s own fees, refunds, chargebacks and disputes are between you, your customer and Stripe. You set your services, prices, hours and cancellation terms, and you are responsible for honouring the bookings your website and chat assistant take for you. We apply your hours and your calendar as you set them, but we do not guarantee that a booking can never clash with something outside Smallstacks, and you should check your calendar as you normally would. Your customers’ details are yours to use for their bookings and under the law that applies to you; you should mention online booking in your own privacy policy.
Stacks Ads
Stacks Ads makes ad images and videos for your business, each with a caption, hashtags, alt text, a title and a description, together with step-by-step instructions for running them on Meta (Facebook and Instagram) and Google Ads. It is a monthly subscription. Each plan includes a number of images and videos per calendar month (“credits”), as shown at checkout. Credits reset at the start of each month and unused credits do not roll over. A batch uses credits only for the ads it actually delivers.
Video ads can include moving footage, a voiceover in an AI-generated voice, and AI-generated music. Videos are made one at a time after you ask for them and can take a while, so we do not promise a delivery time; if a video cannot be made, its credit is not used. A video in the “review” style only quotes a customer review word for word as it appears on your own website, with the name given there: by asking for ads, you confirm that review is genuine and that you may use it in advertising. An ad only mentions an offer, discount or price you gave us.
Review every ad before you use it. You are responsible for what you publish: that it is accurate, that you have the rights to the logo and anything else you provide, and that it follows the rules of the platforms you post to and the laws that apply to your advertising, including the rules on reviews and endorsements. The setup instructions and budget suggestions are a starting point, not professional advice and not a promise of results. You run any paid ads from your own Meta and Google accounts and pay those platforms directly; we are not responsible for what you spend with them or for their decisions about your ads.
As between you and Smallstacks, you may use the ads made for you for any lawful purpose, during and after your subscription.
Stacks Academy
Stacks Academy is sold as seats, at the price shown at checkout ($75 a seat). A seat is paid once: it does not renew, and it does not run out. It is one person’s place in your team, and with it they can open every lesson and guide. The person who buys seats becomes the manager of a new team, or adds the seats to the team they already manage. A manager can see which lessons each person has finished, and can take someone out of the team, which frees their seat for the next person. Everyone in a team signs in with their own Smallstacks account, so the age rule under Eligibility applies to each of them.
If a payment for seats is refunded or disputed, those seats come off the team; people already in it keep their places until the manager takes them out.
The lessons teach general skills for using AI assistants at work. Where a lesson shows the steps for one assistant, they come from that company’s own help pages and are shown only while they have been checked in the last 60 days; assistants still change without telling us, so a button may have moved. The lessons are not legal, security or other professional advice, and your company’s own rules about what may be shared with an AI service come first. Lesson and guide videos are presented by Mac, an AI-made presenter.
Finishing every lesson earns a certificate of completion, issued in the name on your Smallstacks account on the day you finish. It records that you finished the course; it is not an accredited qualification. Once earned it is kept, even if lessons are added to the course later.
The agent desk writes with AI and can be wrong. An agent on the desk only drafts: it cannot send, book, pay for or change anything, and you decide what happens with each draft. If you use an agent on job applicants, it summarizes and does not rank; a person makes every decision, and you are responsible for following the employment laws that apply to you. Each agent has a number of runs a month; when they are used up, it stops until the count starts again. Do not paste in passwords, card numbers, or anything your company says must not be shared.
AI agents built to order
An AI agent starts with a free written plan: the job, what the agent will read, what it asks a person before doing anything, what it never does, the AI service it uses and what is sent to it, a date, and a fixed price within the range shown for that agent on agents.smallstacks.net. The price is paid when the agent is delivered; nothing is paid before then. Asking for a plan costs nothing and commits you to nothing: if you do not want the agent built, you owe nothing.
If you go ahead, we build the agent to the plan, around the tools you already use, for the price in it. For its first week it only drafts: nothing goes out and nothing is changed. After that, anything that leaves your business or changes a record is prepared by the agent and approved by one of your people, one at a time. It gets only the access its job needs, which you grant through your own accounts and can take away, and your people can switch it off at any time without asking us. We train the people who will run it, and the build includes up to three seats in Stacks Academy.
Once the build is paid for, the agent belongs to you: the setup, instructions and code we made for it. There is no monthly fee from us. The outside services it uses, such as the AI service named in the plan, stay theirs and work under their own terms. Running the agent is your cost: what those services charge for its work is yours to pay, and the plan says what that is likely to be.
Acceptable use
You agree not to use the Services, or let others use them, to:
- publish anything unlawful, deceptive, defamatory, hateful, sexually explicit, or that infringes someone else’s rights;
- pretend to be another business or person, or make ads or chat replies about a business you do not run or represent;
- advertise anything illegal where it is shown, or make health, financial or other claims you cannot back up;
- send spam, or use contact details collected through the Services for anything their owner did not ask for;
- overload, probe, copy or resell the Services, or try to get around their limits, trials or security.
We may refuse to make, or remove, content that breaks these rules, and suspend or end the Service for serious or repeated breaches. Where reasonable, we will tell you first and give you a chance to fix it.
Domains
One standard domain name is included in your monthly website plan. We select and register it, we pay the registration and renewal fees for as long as your plan is active, and it is registered in your name: you own it, not Smallstacks. If you cancel, the domain remains yours and you take over its renewal. Premium or previously-owned domains sold above standard registration price are not included; if you want one of those we will tell you the cost before buying anything. If you already own a domain, we will use it and there is nothing to pay.
Cancellation and refunds
You may cancel any product at any time from your Smallstacks account (Manage billing) or by emailing us. Cancellation stops future renewals, and the product keeps working until the end of the period you have paid for.
- Websites: a 7-day money-back guarantee covers both the $250 build fee and your first monthly payment. If you’re not satisfied within 7 days of your first charge, contact us and we refund both in full. After cancellation your website may be taken offline; on request, we will provide a reasonable export of your content. You keep your domain.
- Stacks AI: the free trial is the way to try it. Once a paid month has started, it is not refunded.
- Stacks Ads: once a paid month has started, it is not refunded.
- Stacks Academy seats: seats are paid once and are not refunded.
- AI agents: the plan is free. A build is paid when the agent is delivered and is not refunded.
These limits do not apply where the law gives you a right to a refund, and we may agree to more in a particular case.
Your content and responsibilities
You are responsible for the accuracy of the information you provide and for ensuring you have the rights to any content (text, images, logos, reviews) you give us or that is on your website. You retain ownership of your content and grant us a license to host, display, and adapt it as needed to provide the Services, including using it to make your ads and to answer your visitors. We do not use your content to advertise Smallstacks without your permission.
Our intellectual property
We retain all rights to our platform, software, templates, and underlying technology. Your subscription grants you the right to use the website and tools we provide while your plan is active; it does not transfer ownership of our underlying systems. An AI agent we build for you is the exception: once its build is paid for, it belongs to you, as set out under AI agents built to order.
Third-party services
The Services rely on other companies, such as Stripe for payments, Cloudflare for hosting, Anthropic for AI, and Meta and Google if you run ads. Their own terms apply to your use of them, and we are not responsible for their services or for changes they make.
Service availability
We work hard to keep your site and tools fast and online and aim for high availability, but we do not guarantee uninterrupted or error-free Service. Maintenance, third-party outages, or events beyond our control may cause downtime. We may change or improve features over time; if we stop offering a product you pay for, we will tell you at least 30 days ahead and refund any month paid for but not yet started.
Ending these Terms
You may stop using the Services and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, do not pay, or use the Services in a way that puts other customers, us or the public at risk. Sections that by their nature should continue (such as ownership, disclaimers, limitation of liability and indemnification) continue after the Terms end.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Smallstacks will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three (3) months before the claim.
Indemnification
You agree to indemnify and hold Smallstacks harmless from claims arising out of your content, the ads and chat replies you choose to publish, or your use of the Services in violation of these Terms or applicable law.
Disputes and governing law
If something goes wrong, please contact us first: most problems can be fixed quickly, and we will try in good faith to resolve any complaint within 30 days. These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules.
General
These Terms, with our Privacy Policy and any product terms shown at sign-up, are the whole agreement between you and us about the Services. If any part is found unenforceable, the rest still applies. If we do not enforce a part right away, we have not given it up. You may not transfer your account to someone else without our agreement; we may transfer these Terms if the business is sold or reorganised, and will tell you if we do.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date, and email customers about any change that matters before it applies to them. Continued use of the Services after a change takes effect means you accept it.
